5 Children's Privacy (COPPA Compliance)

ArgoPrep's Platform is directed at children under the age of thirteen (13), and we are fully committed to compliance with the Children's Online Privacy Protection Act ("COPPA"), 15 U.S.C. §§ 6501–6506, and its implementing regulations at 16 C.F.R. Part 312, including the amendments effective in 2025.

Parental Consent Model

ArgoPrep's Platform is designed so that only a parent or legal guardian may create an account. Children cannot independently create accounts, register for the Service, or provide Personal Information directly to ArgoPrep. The account creation process requires the parent to provide their own personal information (name, email, address, phone number) and, where applicable, payment information.

Child profiles are created within the parent's account by the parent. The parent provides a first name and last name for the child (legal names are not required — parents may use nicknames), grade level, and selects an avatar on the child's behalf. At no point does ArgoPrep solicit Personal Information directly from a child.

Verifiable Parental Consent (VPC)

ArgoPrep obtains Verifiable Parental Consent as required by COPPA through the following methods:

  • Payment Transaction: ArgoPrep requires a paid subscription to create an account and child profiles. The payment transaction at the time of subscription signup serves as Verifiable Parental Consent.

Data Minimization

In accordance with COPPA's data minimization requirements, ArgoPrep collects only the minimum amount of information from or about children that is reasonably necessary to allow the child to participate in the educational activities offered on our Platform. Specifically, we collect:

  • First name and last name (or nicknames) — used to personalize the learning experience and identify the child's profile within the parent's account. Legal names are not required; parents may enter any name they use to identify their child.
  • Grade level — used to deliver grade-appropriate educational content.

We do not condition a child's participation in our educational activities on the disclosure of more Personal Information than is reasonably necessary for that participation.

How Children's Data Is Used

Personal Information collected from or about children is used solely to:

  • Provide the educational service (delivering quizzes, video lectures, practice drills, and other learning content appropriate for the child's grade level)
  • Track and record the child's educational activity data (quiz scores, video watch history, progress, and points earned)
  • Display learning progress reports to the child's parent or legal guardian
  • Maintain and secure the child's profile within the parent's account

Children's data is NOT shared with any third party for advertising, marketing, or any non-educational purpose. ArgoPrep does not engage in behavioral advertising, targeted advertising, or any form of commercial profiling directed at children. We do not disclose children's Personal Information to third parties except as necessary to operate the Service (e.g., hosting on Microsoft Azure) and as described in Section 8 of this Policy, and all such third parties are contractually bound to protect such data.

Written Data Retention Policy for Children's Data

In compliance with the COPPA Rule as amended, ArgoPrep maintains a written data retention policy specifically addressing children's Personal Information. Children's Personal Information, including child profile data and educational activity data, is retained only for as long as is reasonably necessary to fulfill the purpose for which it was collected. Specifically:

  • Child profile data (first name, last name, grade level, avatar) is retained only while the parent's account is active or until the parent requests deletion, whichever occurs first.
  • Educational activity data is retained only while the parent's account is active.
  • Upon account closure or upon a parent's request for deletion, all children's Personal Information is deleted within thirty (30) days.
  • ArgoPrep does not retain children's Personal Information indefinitely.

Full details of our data retention practices for all categories of data are described in Section 12 (Data Retention).

6 Parental Rights

Under COPPA and applicable state laws, parents and legal guardians have the following rights regarding their child's Personal Information collected by ArgoPrep:

  • Right to Review: You have the right to review the Personal Information that ArgoPrep has collected from or about your child. You may review your child's profile information and educational activity data at any time by logging in to your ArgoPrep account and navigating to your child's profile and progress dashboard. You may also request a copy of your child's Personal Information by contacting us using the methods described below.
  • Right to Request Deletion: You have the right to request that ArgoPrep delete any and all Personal Information collected from or about your child. Upon receiving and verifying such a request, ArgoPrep will delete the child's Personal Information within thirty (30) days and will confirm the deletion to you.
  • Right to Refuse Further Collection: You have the right to refuse to permit ArgoPrep to collect any further Personal Information from or about your child. Please note that if you exercise this right, your child may no longer be able to use some or all features of the ArgoPrep Platform, as certain information (e.g., a name and grade level) is necessary to provide the educational service.
  • Right to Withdraw Consent: You have the right to withdraw your consent to ArgoPrep's collection, use, and disclosure of your child's Personal Information at any time. Withdrawal of consent will be treated as a request for deletion of the child's Personal Information and may result in the termination of the child's ability to access the Platform.

How to Exercise Your Parental Rights

You may exercise any of the rights described above by:

  • Email: Send a request to info@argoprep.com with the subject line "Parental Rights Request." Please include your name, your child's name (as it appears on the account), and the email address associated with your ArgoPrep account so that we may verify your identity and locate the relevant account.

  • Account Settings: You may review and manage certain child profile information directly through your account settings on the Platform.

7 New York Child Data Protection Act (CDPA) Compliance

In addition to our obligations under COPPA, ArgoPrep complies with the New York Child Data Protection Act ("NY CDPA") and related New York State privacy laws that provide protections for the personal data of minors. ArgoPrep's compliance measures include the following:

  • Parental Consent for Users 12 and Under: ArgoPrep obtains parental consent before collecting any personal data from or about users who are twelve (12) years of age or younger. As described in Section 5, only parents may create accounts and child profiles, and Verifiable Parental Consent is obtained through the payment transaction method.
  • Processing Strictly Necessary for the Educational Service: ArgoPrep processes the personal data of children and minors only to the extent that such processing is strictly necessary for providing the educational service for which the data was collected. We do not process children's or minors' data for purposes unrelated to our educational mission, including but not limited to advertising, commercial profiling, or data brokering.
  • No Sale of Minors' Personal Data: ArgoPrep does not sell, license, or otherwise transfer for monetary or other valuable consideration the personal data of any minor under the age of eighteen (18). This prohibition applies to all categories of personal data and all categories of minors.
  • Third-Party Data Privacy Protections: All third-party service providers that process personal data on ArgoPrep's behalf are contractually required to implement appropriate data privacy and security protections. These contracts limit the third party's use of the data to the specific purposes for which it was shared, prohibit the sale or unauthorized disclosure of such data, and require the third party to implement and maintain reasonable security measures consistent with industry standards.
